Welcome to Newborn Photography by Val!
These terms and conditions outline the rules and regulations for the use of Newborn Photography by Val's Website and services.
By accessing this website or booking a session, you accept these terms and conditions in full. Do not continue to use Newborn Photography by Val's services if you do not agree to all the terms and conditions stated on this page.
1. Introduction
These terms and conditions constitute a legally binding agreement between Newborn Photography by Val (hereinafter "the Photographer") and the client (hereinafter "the Client"). By booking a photography session, the Client agrees to be bound by these terms.
2. Booking and Payment
2.1 A non-refundable deposit of £25 is required to secure your booking and session date. This deposit is deducted from the total cost of your chosen collection.
2.2 The remaining balance is due on the day of the session.
2.3 Sessions are booked on a first-come, first-served basis. Your booking is only confirmed upon receipt of the signed agreement and deposit.
3. Rescheduling and Cancellations
3.1 The Photographer understands that babies are unpredictable. If your newborn arrives earlier or later than expected, please contact me as soon as possible to reschedule. I will make every effort to accommodate you.
3.2 If the Client needs to reschedule for any reason other than the birth of the child, at least 7 days' notice must be given. One reschedule is permitted, subject to availability. Subsequent reschedules will incur a £50 rebooking fee.
3.3 If the Client cancels the session entirely, the deposit is non-refundable.
3.4 In the unlikely event the Photographer has to cancel due to illness or unforeseen circumstances, a full refund of all monies paid will be offered, or a new session date will be scheduled.
4. Session Arrangements
4.1 The Photographer will provide a pre-session consultation to discuss the Client's preferences and expectations.
4.2 The session will take place at the Photographer's studio in High Wycombe or an agreed-upon location (for home shoots).
4.3 It is the Client’s responsibility to ensure the newborn is fed and comfortable prior to the session to facilitate a smooth session.
4.4 Lateness Policy: The session time is reserved exclusively for you. If the Client is more than 20 minutes late without prior communication, the session may be cancelled, and the deposit forfeited. Lateness will cut into your session time and may result in fewer final images.
4.5 Your Baby’s Safety: The health and safety of your baby is my utmost priority. I am fully insured, DBS checked, and trained in paediatric first aid. The session is baby-led, and I will never force a pose. A parent or guardian must remain present and assist as needed throughout the session to ensure the baby's safety at all times.
5. Artistic Rights
5.1 The Photographer retains the right to use their professional judgment regarding the style, artistic composition, and number of images captured.
5.2 The Client understands and agrees that the final gallery will reflect the Photographer's creative style.
5.3 Due to the nature of working with newborns, the Photographer cannot guarantee any specific pose or image. The session's success depends on the baby's temperament and cooperation.
6. Image Delivery
6.1 The final gallery of professionally edited, high-resolution digital images will be delivered to the Client within 2-3 weeks of the session date.
6.2 The number of images delivered is as specified in the chosen collection (e.g., 15 for The Essence Collection, 25 for The Legacy Collection).
6.3 All editing is performed at the Photographer's discretion. Additional edits requested by the Client may incur a fee starting from £20 per image.
6.4 The Client will receive a password-protected online gallery for digital download. This gallery will be active for 7 days. It is the Client's responsibility to download and back up their images within this time. A £25 admin fee will be charged to reactivate an expired gallery.
6.5 Raw (unedited) image files are not provided under any circumstances.
7. Copyright and Reproduction
7.1 Newborn Photography by Val retains the entire copyright and ownership of all images created at all times.
7.2 The Client receives a print license for the high-resolution digital files, allowing them to make personal prints and share images online. The Client must credit Newborn Photography by Val when sharing on social media.
7.3 Commercial use of the images (including but not limited to advertising, commercial contests, or selling the image) is strictly prohibited without the Photographer's written consent.
7.4 The Client may not alter, edit, or apply filters to any of the images. This includes cropping, changing colours, or removing the Photographer's logo.
7.5 Newborn Photography by Val retains the right to use any images for promotional purposes, including on its website, portfolio, social media, and marketing materials.
8. Model Release
8.1 By booking a session, the Client grants the Photographer permission to use the resulting images for self-promotion as stated in 7.5.
8.2 If the Client wishes to purchase the full copyright for the images or opt out of the model release, this must be requested in writing at the time of booking. An additional fee of £500 applies for the purchase of full copyright and privacy.
9. Liability
9.1 The Photographer is not liable for any injury or accident that may occur to the Client, their children, or their property during the session.
9.2 The Photographer is not responsible for the loss of digital files due to client error, hardware failure, or failure to download the gallery within the specified time frame.
10. Force Majeure
The Photographer is not liable for any failure or delay in performing obligations due to circumstances beyond reasonable control, including but not limited to illness, accident, acts of God, or government restrictions.
11. General
11.1 These terms represent the full agreement between the Photographer and the Client.
11.2 Prices are subject to change without notice.
11.3 Returns Policy: Due to the custom nature of photography, all sales are final. No refunds or exchanges are given on digital files or products once an order is placed. In the case of faulty printed products, a replacement will be provided.
12. Gift Vouchers
12.1 Gift vouchers are valid for 12 months from the date of purchase and are non-refundable.
12.2 Vouchers cannot be exchanged for cash and must be presented at the session.
By booking a session with Newborn Photography by Val, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
